  • Elder Law: Guardianship and Conservatorship

There are, generally speaking, four main areas of Elder Law: Issues with Elder Guardianship and Conservatorship; Long-Term Care Issues; Estate Planning for Elder Care; and Elder Abuse and Neglect.

  • Elder Law: Long-Term Care

One of the most heartbreaking events in our lives is when a loved one, generally a mother or father, can no longer care for themselves or are no longer capable to make sound decisions. There are many circumstances in which a person may become incapacitated such as falling into a coma, being mentally challenged, have a form of dementia, suffer a stroke or brain injury. In these cases, it usually falls to the children and/or siblings to manage the incapacitated person’s finances and other affairs.

 

If the loved one in need does not have a designated guardian or conservator, an attentive relative can step in to establish a guardianship and/or conservatorship. An experienced and qualified elder care attorney can appeal to the court on behalf of the family member to be appointed, or ask the court to appoint someone else as a guardian or conservator.  If there are no close family members, the court will consider other relatives or friends.

 

A guardianship can be one or more individuals who are given the legal authority to make decisions regarding the incapacitated or incompetent person’s medical treatment, living arrangements, health and safety needs. A conservatorship gives one or more persons the legal authority to manage the incapacitated or incompetent person’s finances such as handling bank accounts, investments, property and other assets. The conservator would pay bills, gather all debts and manage the overall cash flow of the person’s estate.

 

If the incapacitated person has already designated a guardian or conservator in a living will, durable power of attorney or medical power of attorney, the court will usually abide by those wishes and appoint that designated person. One person could act as both guardian and conservator. The court however, may choose to appoint someone else if the court feels the designated person is not best suited to serve the interests of the loved one in need. The court may also hold hearings to review all the facts to evaluate the loved one’s health and mental capacity.

 

More often, these areas of law can be highly emotional. Children and siblings may have conflicting views at determining what’s best for the loved one. If an agreement does not come into place regarding these conflicts, the court may choose a guardian and/or conservator after considering abilities, character and other factors. The court may also decide a neutral attorney or distant relative is best suited as the guardian and/or conservator.
