Life After Foreclosure- The Boomerang Buyers

The past seven years have been horrendous for millions of homeowners who lost their homes. Somewhere between 7 and 8 million homes were lost. The majority of homes lost to foreclosure were around 6 million. These were mostly due from distressed homeowners who suffered hardships ranging from losing their jobs to serious health issues. Around 2 million homes were sold as a short-sale (sold for less than what was owed) and given back to the lender by a deed-in-lieu (DIL) that a

HUD Charges Three Loan Mod Firms With Scamming, Foreclosure Fraud

Our law office continues to receive numerous calls from homeowners who were scammed by so-called ‘loan modification’ companies. Most of the ‘loan modification scammers have companies based in California, Florida, New York and New Jersey. By the time the homeowner figures out the scam, they’ve lost between $700 and $5,000 on average and/or received a notice they are in foreclosure. Some homeowners have had no idea they’ve been scammed until someone comes to their door with doc

HOA Loses Battle Over Childrens' Play Set Color

We receive calls almost daily from homeowners who are having a dispute with their Homeowners’ Association and need help fighting these special groups. In Colorado alone, we have over one million residents who live under the rules and laws of an HOA. The common thread we hear is the HOA elected a new board, someone on the board doesn’t like the homeowner, the HOA became power-hungry or a particular neighbor keeps complaining. Many HOAs believe they have absolute authority and

Short Sales: Pros, Cons and Fraud

Lenders may offer distressed homeowners the option of a short sale. A short sale is selling a home for less than what is owed on the loan. There are many reasons a seller will choose a short sale as an option; a transfer of employment, divorce, death of a spouse, retirees who want to move or the property is underwater. There are also reasons not to take a short sale. A short sale can have a negative impact on your credit history and score and not allow you to purchase any rea

    HOAs from Hell

More than forty years ago, developers began ‘common-interest housing’ as a way to cut costs and taxes and built more units on less land. Instead of providing each house with it’s own conveniences, they began the movement of “shared amenities”. Because these communities were private developments, local laws and authority didn’t oversee or have to maintain them. The responsibilities to govern these communities fell to volunteer committees. Thus the Homeowner’s Associations (HOA

Buyer's Remorse - Can You Get Out Of a Real Estate Contract?

Buyer’s remorse: a sense of regret after making a purchase, usually associated with a large-ticket item such as a home or a car. Most of us have experienced Buyer’s Remorse at some point in our lives. We buy something expensive, then ask ourselves whether we were pushed into buying? Would we have found a better deal somewhere else? Some of us just feel guilty spending so much. Whatever the case of regret, and you decide you don’t want the item, “Can you back out of this cont

New Rules for Reverse Mortgages in Lenders' Hands

The Department of Housing and Urban Development (HUD) and the Federal Housing Administration (FHA) issued new rules they claim will protect spouses in reverse mortgages. Before these new rules, if you weren’t listed as a borrower on a reverse mortgage and the spouse died, you would be subject to imminent foreclosure. In a landmark District of Columbia federal court ruling, the non-borrowing spouse was recognized and, the need to protect that spouse [Bennett et al. v Donovan].
